Please read carefully. By registering an account or using Sales Monitor, you agree to these Terms. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.
To use Sales Monitor, you must register an organisation account and provide accurate, complete, and current information. You are responsible for:
Each Tenant organisation receives an isolated workspace. Data from one Tenant is not accessible to any other Tenant.
Sales Monitor is offered on three subscription tiers: Starter (RM99/month), Pro (RM299/month), and Enterprise (RM799/month). Prices are in Malaysian Ringgit and exclude applicable taxes (SST). Current pricing is available at salesmonitor.io/pricing.
New tenants receive a 14-day free trial on the Pro plan. No credit card is required to start the trial. At the end of the trial, the account automatically downgrades to the Starter plan unless a subscription is activated.
Subscriptions are billed monthly in advance. Payment is processed by Stripe. By providing payment details, you authorise us to charge the applicable subscription fee on each billing date. All payments are non-refundable except as described in our Refund Policy.
You may upgrade or downgrade your plan at any time through the Billing portal. Upgrades take effect immediately. Downgrades take effect at the end of the current billing period. Feature access adjusts accordingly when the change takes effect.
If payment fails, we will retry up to three times over 7 days. If payment remains outstanding, your account will be restricted and then suspended. You will receive email notifications throughout this process. Data is retained for 30 days after suspension before deletion.
You are responsible for any taxes, duties, or levies applicable to your use of the Service in your jurisdiction. We will charge and remit Malaysian SST where required by law.
You agree not to use the Service to:

Your data is yours. Tenant Data remains the property of the Tenant. We do not claim any ownership over your data. You grant us a limited licence to store and process Tenant Data solely to provide the Service.
You can export all Tenant Data at any time from Settings → Data & Privacy. Upon termination, we will provide a final export window of 30 days before deleting all Tenant Data.
We may use anonymised, aggregated data (which cannot identify any individual or organisation) to improve the Service and produce industry benchmarks.
Sales Monitor and all associated software, designs, trademarks, and documentation are the property of Sales Monitor Sdn. Bhd. These Terms do not grant you any rights in our intellectual property beyond the limited right to use the Service as described.
You retain full ownership of any content, data, or materials you submit through the Service.
We target 99.5% monthly uptime for the API and dashboard. Scheduled maintenance will be announced via the dashboard banner and email at least 24 hours in advance. Emergency maintenance may occur without advance notice.
The mobile app includes offline functionality; field activities can continue during connectivity outages and will sync when connectivity is restored.
We do not guarantee specific response times or uptime beyond what is stated in this section. Service credits for downtime are available to Enterprise plan customers under a separate SLA agreement.
You may cancel your subscription at any time via the Billing portal. Cancellation takes effect at the end of the current billing period. You retain access until the period ends.
We may suspend or terminate your account immediately if you:
Upon termination, your access to the Service ceases. Tenant Data is retained for 30 days in a read-only state for export, then permanently and irreversibly deleted. Stripe invoice history is retained as required by law.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.
In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of data, or business interruption, even if advised of the possibility of such damages.
⚠️ Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Sales Monitor and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; (c) your infringement of any third-party rights; or (d) your failure to obtain proper consent from employees for monitoring.
These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
We may update these Terms from time to time. Material changes will be communicated via email and an in-dashboard notice at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance.
If you do not agree to updated Terms, you may cancel your subscription before the effective date.
